Career Inspiration Career Coaching Terms and Conditions
- Purpose
Career Coach agrees to provide Coaching Services for Client focusing on the topics/results/outcomes/goals as mutually agreed between Coach and Client.
- Description of Coaching
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals.
- Coach-Client Relationship
The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. It is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
Client is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
- Services
Coach and Client agree to engage in online or person meetings as well as coaching activities as mutually agreed upon to be completed by Client between in person/online meetings. Each meeting duration and frequency shall be defined by the relevant coaching program. Coach will be available to Client by e-mail and text message in between scheduled meetings and will endeavour to respond within 48 hours.
- Schedule and Fees
Fees are payable within 7 days of Invoice.
- Procedure
The time and location of the coaching meetings will be determined by Coach and Client based on mutual agreement.
- Confidentiality and Privacy of Information
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, will be held in strict confidence. Any personal information obtained in relation to this terms and conditions may only be collected, held, used, and distributed in accordance with the Privacy Act 2020 or any replacement legislation.
The Coach will not disclose the Client’s name as a reference without the Client’s consent.
The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
- Release of Information
Topics and Client evaluations of the coaching service may be anonymously and hypothetically shared with other coaching professionals, strictly for the purpose of the Coach’s own professional development.
- Intellectual Property
Client agrees not to reproduce, duplicate, copy, sell, trade, or exploit for any commercial or personal purposes, any portion of the Program, including any of the Program materials.
- Cancellation Policy
Client agrees that it is the Client’s responsibility to notify the Coach of meeting cancellation at least 24 hours in advance of the scheduled meetings.
- If the Client cancels a meeting within 24 hours of the scheduled in person meeting, or the client does not show up to the in person meeting, the client agrees to pay an additional $40 cancellation fee.
- If the Client cancels a meeting where written notice is received by the Coach more than 24 hours before the scheduled in person meeting, the client will not be charged the $40 cancellation fee.
- If the scheduled in person meeting is cancelled by the Coach no cancellation fee will be charged.
Coach will attempt in good faith to reschedule the cancelled/missed meeting.
- Termination
Either the Client or the Coach may terminate this Program at any time with 48 hours written notice.
- Limited Liability
Except as expressly provided in this Terms and conditions, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered.
- Health and Safety
Both Coach and Client are responsible for complying with the Health and Safety at Work Act 2015 and all regulations and codes of practice made under that Act.
- Force Majeure
Whilst we do our best to do all we promise, there will be times when circumstances beyond our control prevent this. These circumstances include (but are not limited to) natural disasters, political action and war, failure of electricity, internet or telephone services, illness.
If this kind of thing disrupts our work we will do all we can to minimise disruption, to keep you informed, and to honour our commitments as a service provider.
Under such circumstances our contract remains in place and neither party shall be eligible to cancel the agreement unless by mutual written consent.
- Legal Jurisdiction
These terms and condition are written in and will be enforced under law applicable in New Zealand.
- Other Conditions
These terms and conditions are subject to change without notice.
By engaging as a client in any of the coaching services offered by Career Inspiration you agree to these terms and conditions.
